Bitcoin Near $86,000 as SEC Custody Rules Take Shape

Bitcoin trades near $86,000 while DeFi liquidity expands and the SEC proposes a clearer crypto-custody framework. Investors should separate improving market access from unresolved policy and liquidity risks.

FRED chart of the daily Bitcoin price in US dollars

Bitcoin traded around $86,100 on 5 October, within an intraday range of roughly $84,900 to $86,950, as investors weighed improving on-chain liquidity against an unfinished US regulatory framework. The market signal is constructive but not decisive: Bitcoin is holding a high nominal level, DeFi activity has recovered, and regulators are opening more routes for institutional participation, yet policy proposals are not final rules and liquidity remains concentrated in a small number of assets.

For investors, the more useful question is not whether October is seasonally bullish. It is whether spot demand, stablecoin liquidity and the cost of leverage are improving together. A rally supported by all three is more durable than one driven mainly by derivatives positioning.

Liquidity is improving, but breadth is limited

DefiLlama reported total DeFi value locked near $96.6 billion and stablecoin market capitalisation around $307.1 billion on 5 October. Stablecoin supply was up only about 0.2% over seven days and 1.1% over 30 days. That points to gradual liquidity creation rather than a broad speculative surge.

The composition also matters. Tether represented about 60% of tracked stablecoin supply, while USDC remained the second-largest asset. High concentration makes settlement liquidity deep in the leading tokens, but it also leaves the ecosystem exposed to issuer, banking and regulatory risks. Investors should therefore treat total value locked and stablecoin supply as balance-sheet indicators, not as automatic buy signals.

The SEC proposal could widen institutional access

On 1 October, the US Securities and Exchange Commission proposed tailored custody rules for registered investment advisers and regulated funds. The proposal would permit state trust companies to serve as crypto custodians if specified safeguards are met and would allow adviser self-custody in limited circumstances when no permitted custodian is available. The public-comment period remains open, so the framework may change before adoption.

This matters because custody has been a practical bottleneck for institutions. Clearer rules could expand the addressable market for funds, advisers and service providers, supporting fee revenue for compliant custodians and exchanges. The counterpoint is that implementation raises compliance, audit and capital costs and may favour large incumbents over smaller platforms.

Broader market-structure legislation is also unresolved. A US Senate procedural vote on the CLARITY bill failed in September, showing that agency action can improve near-term access without eliminating longer-term legislative uncertainty.

What the market is pricing

Bullish interpretation: Bitcoin is absorbing macro and policy uncertainty while stablecoin supply grows and institutional custody options improve. Sustained spot demand, falling funding rates and rising on-chain fees would strengthen that case.

Bearish interpretation: the price is being supported by a narrow pool of liquidity, while regulatory proposals remain reversible and DeFi valuations still depend heavily on token prices. A stronger dollar, higher real yields or renewed ETF outflows could expose weak breadth quickly.

What investors should monitor next

  • spot Bitcoin ETF net flows and whether demand persists during down days;
  • perpetual-futures funding, open interest and liquidation concentration;
  • stablecoin supply growth and issuer concentration;
  • DeFi fees and revenue, not only headline value locked;
  • changes to the SEC custody proposal after public comments;
  • progress, or renewed delay, in US market-structure legislation.
